1. About these Terms
These Terms of Service (Terms) apply when you access or use The Toymaker’s Journal website, purchase or download a product, create an account, subscribe to communications, or otherwise interact with us.
In these Terms:
· “TMJ”, “we”, “us” and “our” mean The Toymaker’s Journal.
· “Website” means our online store, pages and related online services.
· “Product” includes a digital product, pattern, template, instruction manual, guide, bundle, supporting file, physical item or other product offered by us.
· “Digital Product” includes a downloadable PDF, printable pattern, template, instruction manual, guide, illustration, supporting digital file or digital bundle.
· “Pattern” includes the pattern pieces, diagrams, drawings, instructions, photographs, illustrations, layout and supporting files supplied with a TMJ design.
· “you” and “your” mean the person accessing the Website or purchasing or using a Product.
By using the Website or purchasing a Product, you agree to these Terms and any additional terms displayed on the relevant product page, including the Pattern Use and Small-Maker Licence. If you do not agree, do not use the Website or purchase or download our Products.
2. Eligibility and authority
You must have legal capacity to enter into a binding agreement. If you are under 18, you may use the Website or purchase a Product only with the involvement and permission of a parent or legal guardian.
If you purchase or use a Product for a business, organisation, school, club or other entity, you confirm that you have authority to bind that entity to these Terms.
3. Changes to these Terms
We may update these Terms from time to time to reflect changes to our Products, business practices, technology or legal obligations. The updated version will be published on the Website with a revised “Last updated” date.
The Terms applying to a purchase will generally be those published when the order was placed. Changes do not remove rights that have already arisen or any rights that cannot lawfully be limited.
4. Website information and availability
We take reasonable care to keep the Website and product information accurate and available. However, the Website may occasionally contain typographical errors, technical interruptions, outdated information or temporary faults.
We may correct errors, update information, suspend access for maintenance, or change or discontinue Website features. We will not knowingly use corrections to avoid an order already accepted, except where necessary to correct an obvious error, comply with law, or address circumstances outside our reasonable control.
Product photographs, screen images and illustrations are provided to help describe the Product. Colours may vary between screens, printers, inks, paper, timber, paint and finishing materials.
5. Product descriptions
Each product listing should be read carefully before purchase. The listing may state:
· whether the Product is digital or physical
· the files, pages or components included
· the intended paper size, print scale or tiling method
· recommended tools, materials and techniques
· the general skill level or project complexity
· the applicable use and licensing conditions
Unless a listing clearly says otherwise, a digital pattern purchase does not include a completed wooden item, timber, tools, paint, hardware, printing services or physical delivery.
Skill-level descriptions are general guides. Individual experience, tools and working methods vary. A description such as “beginner-friendly” does not guarantee that every purchaser will complete the project without difficulty or assistance.
6. Prices, currency and taxes
Prices are displayed in the currency shown at checkout. Where Australian dollars are displayed, they are shown as AUD. Prices may include or exclude GST depending on our registration status, the customer’s location, the sales channel and the information displayed at checkout.
You are responsible for any tax, duty, currency-conversion fee, international transaction fee or other charge imposed by your government, bank, card issuer or payment provider, unless the law requires us to collect or pay it.
We may change prices at any time. A price change will not ordinarily affect an order already accepted and paid, except where there is an obvious pricing error or the law requires a correction.
7. Orders and acceptance
Placing an order is an offer to purchase the selected Product on these Terms. An order is accepted when we send an order confirmation, provide download access, dispatch the physical item, or otherwise confirm acceptance.
We may refuse or cancel an order where reasonably necessary, including where:
· payment is not authorised or is reversed
· the Product is unavailable
· there is an obvious pricing, description or system error
· fraud, misuse, unauthorised resale or unlawful activity is reasonably suspected
· the order breaches these Terms or an applicable licence
· we are required to do so by law
If we cancel an order after payment has been received and no Product has been validly supplied, we will provide an appropriate refund. This does not limit any other remedy required by law.
8. Payment
Payment must be made using a payment method offered at checkout. Payments may be processed by Shopify or another third-party payment provider. Their terms, privacy practices, security requirements and processing times may also apply.
You confirm that you are authorised to use the selected payment method and that the information supplied is accurate. We do not ordinarily receive or store complete card details where payment is processed by a third-party provider.
We may delay delivery or access while payment is pending, under review or unsuccessful.
9. Digital delivery and access
Digital Products are supplied electronically, usually through a download page, order confirmation, customer account, email link, or digital delivery service. No physical item will be posted unless the listing clearly states otherwise.
You are responsible for providing an accurate email address and maintaining access to it. You are also responsible for having a suitable device, an internet connection, storage space, a PDF reader, a printer, and other equipment reasonably required to use the Product.
Download links may be subject to technical limits, expiry periods or security restrictions imposed by the Website or delivery service. You should download your files promptly and keep a secure personal backup.
If you cannot access a purchase, contact us with your name, order number, the email address used at checkout, the product name, and details of the problem. We may request reasonable proof of purchase before resending or transferring access.
10. Printing and pattern scale
You must follow the printing instructions supplied with the Product. Depending on the pattern, this may require selecting “Actual size” or “100%”, disabling “Fit to page”, checking a test square, using the stated paper size, and assembling tiled pages in the stated order.
We are not responsible for materials lost because a correctly supplied pattern was printed at the wrong scale, altered by printer settings or assembled incorrectly. If the supplied file itself contains a significant scale or production error, contact us so we can investigate and provide the remedy required by law.
11. Ownership of Products and intellectual property
All intellectual property rights in the Website and Products remain owned by TMJ or the relevant rights holder. These rights may include copyright in written instructions, pattern pieces, drawings, diagrams, photographs, illustrations, graphics, logos, trade names, page layouts, product descriptions and supporting files.
Purchasing or downloading a Product gives you a limited right to use it under these Terms and the applicable licence. It does not transfer copyright, design ownership, trade mark rights or any other intellectual property ownership to you.
The Toymaker’s Journal name, branding and logos may not be used in a way that suggests sponsorship, endorsement, partnership or authorship without prior written permission.
12. Pattern Use and Small-Maker Licence
Unless a product listing states a different licence, purchasing a TMJ Pattern grants the purchaser a limited, non-exclusive, non-transferable and revocable licence to use that Pattern as follows.
12.1 Permitted use
You may use the Pattern to create finished items for:
· your own personal use
· gifts
· charitable donations
· small-scale handmade sales by the individual purchaser or within the purchaser’s own small maker business
Finished items offered for sale must be genuinely made within the small maker business and must not be represented as having been designed by the purchaser.
12.2 Uses requiring a separate written licence
Prior written permission and a separate commercial licensing agreement are required for:
· mass production or factory production
· large-scale or production-line manufacturing
· outsourced or third-party manufacturing
· commercial production by employees, contractors or manufacturers beyond genuine small-maker production
· large-scale wholesale supply or supply to major retailers
· automated batch production or other commercial-scale use
· any use that a product listing expressly identifies as requiring additional permission
Commercial licensing enquiries may be sent to hello@thetoymakersjournal.com. No commercial manufacturing licence exists unless it has been agreed in writing by TMJ.
12.3 Pattern restrictions
You must not, without prior written permission:
· copy, scan, share, lend, email, upload, publish, sell, sublicense or redistribute the Pattern or any part of it
· provide the Pattern to a customer, employee, contractor, club, school, class, library, online group, file-sharing service or third-party manufacturer
· use any part of the Pattern to create or sell another pattern, template, plan, tutorial, kit, course or digital product
· trace, redraw, alter or reformat the Pattern for distribution or sale
· convert or distribute the Pattern as an SVG, DXF, CAD, CNC, laser-cutting or other production file
· remove copyright notices, watermarks, branding or identifying information from the supplied files
· claim the design, drawings, instructions or photographs as your own
· use the Pattern or files to train, fine-tune, test or supply data to an artificial intelligence system, machine-learning model or generative design service
Reasonable working copies may be made only for the purchaser’s own permitted use, such as printing the pages needed to complete the project or storing a personal backup. Those copies remain subject to these Terms.
12.4 Modifications to finished projects
You may make practical or decorative changes when producing your own permitted finished items. A modification does not transfer ownership of the underlying TMJ design and does not permit you to distribute the altered Pattern or create a competing pattern or digital file.
We cannot guarantee the safety, structural integrity, fit or finished result of changes made to measurements, proportions, joinery, materials, thicknesses, construction methods or other design elements.
12.5 Classroom, club and group use
A standard single-purchaser licence does not permit distribution of copies to a class, club, workshop, school, library, men’s shed, community group or other group. Contact TMJ for written permission or an appropriate group licence before reproducing or distributing Pattern materials for group use.
13. Finished items, safety and legal compliance
TMJ supplies designs, templates and instructions. You are responsible for how you manufacture, finish, market, label, test, sell or otherwise use any finished item made from a Pattern.
You are responsible for:
· using tools and machinery safely and following manufacturer instructions
· wearing suitable personal protective equipment
· maintaining appropriate dust control, ventilation and workshop practices
· selecting suitable timber, hardware, adhesives, paints and finishes
· checking dimensions, stability, strength and construction quality
· supervising children and keeping tools, small parts and hazardous materials away from them
· determining the appropriate intended use and age suitability of a finished item
· complying with all product-safety, labelling, consumer, tax, business and other laws that apply where you make or sell finished items
Permission to sell finished items under the small-maker licence is not a representation that a finished item automatically complies with the laws or safety standards of any country. Compliance depends on the maker’s materials, construction, finishing, testing, marketing and intended use.
Nothing in these Terms excludes liability that cannot lawfully be excluded.
14. Photographs and marketing of finished items
You may photograph and advertise finished items that you have personally made under the applicable licence. You may state that the item was “made from a pattern by The Toymaker’s Journal” or use similar accurate attribution.
You must not use TMJ’s original product photographs, illustrations, listing images, logos or written copy in your own advertising unless we give written permission. You must not imply that your finished items were made, tested, approved or sold by TMJ.
15. Refunds, returns and corrections
Our separate Returns and Refund Policy forms part of these Terms and should be read before purchasing.
Because Digital Products can be downloaded, saved and retained, we do not ordinarily provide refunds for change of mind. However, nothing in these Terms or our Returns and Refund Policy excludes, restricts or modifies consumer guarantees or any other right or remedy that cannot lawfully be excluded.
If a Product is faulty, corrupted, missing a stated component, substantially different from its description or otherwise fails to meet an applicable consumer guarantee, contact us. Depending on the circumstances and the law, an appropriate remedy may include assistance, correction, replacement, resupply, a partial refund, or a full refund.
16. Accounts and account security
Where customer accounts are available, you are responsible for maintaining the confidentiality of your login details and for activity occurring through your account. Tell us promptly if you suspect unauthorised access.
You must provide accurate information and must not create an account using another person’s identity, payment details or email address without authority.
We may suspend or restrict an account where reasonably necessary to protect customers, the Website, our intellectual property, or the security and integrity of our services. We will not use this right to avoid obligations that have already arisen under consumer law.
17. Acceptable use of the Website
You must not use the Website:
· for unlawful, fraudulent, misleading or abusive purposes
· to infringe intellectual property, privacy or other rights
· to transmit malware, harmful code or automated attacks
· to scrape, harvest, copy or systematically extract Website content without permission
· to interfere with the Website, servers, security or another user’s access
· to impersonate another person or misrepresent your affiliation with TMJ
· to make false chargebacks, payment disputes or refund claims
· to circumvent access controls, download limits, watermarking or licensing restrictions
We may take reasonable steps to investigate and address misuse, including restricting access, cancelling a licence, preserving evidence, contacting service providers or pursuing available legal remedies.
18. Reviews, comments and customer content
If you submit a review, photograph, comment, testimonial or other content to us or through the Website, you confirm that you have the right to submit it and that it is accurate, lawful and does not infringe another person’s rights.
You retain ownership of your original content. By submitting it for publication, you grant TMJ a non-exclusive, worldwide, royalty-free licence to display, reproduce and share that content for operating and promoting TMJ, subject to applicable privacy law and any express agreement with you.
We may moderate or remove content that is unlawful, abusive, misleading, irrelevant, infringing, contains private information, or breaches these Terms. We will not alter a genuine customer review in a way that misrepresents the customer’s opinion.
19. Email and marketing communications
Transactional communications, such as order confirmations, download links, security notices and support replies, may be sent where necessary to complete or manage your purchase.
Marketing emails will be sent in accordance with applicable law and the choices available when you subscribe. You may unsubscribe using the link provided in a marketing email. Unsubscribing from marketing does not prevent necessary transactional communications about an order.
20. Privacy
Our handling of personal information is described in our Privacy Policy. The Privacy Policy should be read together with these Terms.
We may use service providers, including ecommerce, payment, email, analytics, hosting, and digital delivery providers, to operate the Website and fulfil orders. Their own terms and privacy practices may apply to the services they provide.
21. Third-party services and links
The Website may contain links to or rely on third-party platforms and services, including Shopify, payment processors, email providers, social platforms and external websites. We do not control all third-party content or availability.
A link does not necessarily mean that TMJ endorses the third party. You are responsible for reviewing the third party’s terms and privacy practices. Nothing in this clause limits our responsibility for our own conduct or obligations.
22. Website security and interruptions
We use reasonable measures to operate the Website securely, but no internet service can be guaranteed to be uninterrupted, error-free or completely secure. You should use current security software, protect your passwords, maintain backups and take reasonable care when downloading files.
We are not responsible for loss caused solely by your device, internet connection, unsupported software, printer configuration, security breach or failure to maintain a backup, except to the extent that responsibility cannot lawfully be excluded or the loss was caused by our breach.
23. Consumer guarantees
Our Products come with guarantees that cannot be excluded under the Australian Consumer Law where that law applies. These may include guarantees that Products are of acceptable quality, fit for a disclosed purpose and match their description.
The remedies available may depend on whether a failure is major or minor and on the circumstances of the transaction. These Terms do not replace, reduce or override those rights.
24. Disclaimers
To the extent permitted by law:
· general information on the Website and in Products is provided for practical and educational purposes and is not legal, engineering, product-safety, medical, financial or other professional advice
· you are responsible for deciding whether a Product and project are suitable for your experience, tools, materials and intended use
· finished results may vary because handmade work depends on materials, equipment, skill, printing, cutting, assembly, sanding, painting, finishing and modifications
· we do not guarantee uninterrupted Website access, a particular business outcome, sales volume, profit or market acceptance from using a Pattern
These disclaimers do not apply where they would unlawfully exclude or restrict a guarantee, warranty, condition, liability, right or remedy.
25. Limitation of liability
Nothing in these Terms excludes, restricts or modifies liability, rights or remedies that cannot lawfully be excluded, restricted or modified.
To the extent permitted by law, TMJ is not liable for indirect or consequential loss, loss of profit, loss of opportunity, loss of data, business interruption, or loss arising from a customer’s unsafe practices, unauthorised modification, unlawful manufacture, incorrect printing, unsuitable materials, or use outside the applicable licence.
Where the law permits liability to be limited, our liability will be limited to a remedy or amount that is fair and reasonable in the circumstances, taking into account the nature of the Product, the price paid, the cause of the loss, and any mandatory legal rights. This clause is not intended to impose a limit that would be unfair or unenforceable.
26. Your responsibility for claims arising from your conduct
You are responsible for loss, damage, cost or claim caused by your unlawful conduct, infringement of another person’s rights, unauthorised distribution of a Pattern, or manufacture and sale of finished items in breach of these Terms.
Where permitted by law, you agree to reimburse TMJ for reasonable loss and legal costs directly resulting from that conduct. This clause does not apply to the extent that the loss was caused by TMJ, would make the contract unfair, or cannot lawfully be imposed.
27. Suspension and termination
You may stop using the Website at any time. Rights relating to an existing purchase continue according to the applicable licence unless that licence is terminated for a material breach.
We may suspend Website access or terminate a licence where you materially breach these Terms, including by distributing a Pattern, infringing intellectual property, using the Website unlawfully or failing to pay for a Product.
Where reasonably possible, we may give notice and an opportunity to remedy the breach. Immediate action may be taken where necessary to prevent ongoing infringement, fraud, security harm or unlawful conduct.
Termination does not affect rights or liabilities that arose before termination. Clauses concerning intellectual property, licence restrictions, payments, liability, disputes and other matters intended to continue will survive termination.
28. Events outside reasonable control
Neither party is responsible for delay or failure caused by events outside its reasonable control, such as natural disasters, fire, flood, widespread network failure, government action, industrial disruption, serious illness, platform outage or payment-system failure.
This clause does not remove obligations to provide refunds or other remedies where required by law. The affected party should take reasonable steps to reduce the impact and, when practicable, resume performance.
29. Complaints and disputes
Please contact us first so we can resolve your concern promptly and fairly.
Send your name, order number, email address used at checkout, product name, a clear explanation of the problem, relevant evidence and the outcome you are seeking to hello@thetoymakersjournal.com.
We may ask for reasonable additional information. Both parties agree to communicate in good faith and, where appropriate, to attempt to resolve the issue directly before commencing formal proceedings.
Nothing in this clause prevents either party from seeking urgent relief, contacting a consumer protection body, exercising a statutory right, or commencing proceedings where necessary.
30. Governing law
These Terms are governed by the laws of New South Wales, Australia, and the laws of the Commonwealth of Australia that apply there.
Subject to any mandatory consumer right to bring a claim elsewhere, the parties submit to the courts and tribunals with jurisdiction in New South Wales, Australia.
31. General provisions
31.1 Entire agreement
These Terms, the relevant product listing, the Returns and Refund Policy, the Privacy Policy, and any applicable written licence form the agreement relating to your use of the Website and your purchase of the Product. If there is a conflict, a specific written term for the Product will prevail to the extent of that conflict, provided it is lawful.
31.2 Severability
If a provision is found to be invalid, unlawful or unenforceable, it will be read down to the minimum extent necessary. If it cannot be read down, it will be severed, and the remaining provisions will continue to apply.
31.3 No waiver
A failure or delay in enforcing a right does not waive that right. A waiver is effective only when clearly given and applies only to the specific circumstance for which it was given.
31.4 Assignment
You may not transfer or sublicense your purchase or licence without written permission. We may transfer our rights and obligations as part of a genuine sale, restructure or transfer of the business, provided that doing so does not reduce your mandatory consumer rights.
31.5 Headings
Headings are for convenience and do not change the meaning of these Terms.
31.6 Electronic communications
You agree that contracts, notices, invoices, policies and other communications may be provided electronically, subject to applicable law.
32. Contact details
