This Small Maker Commercial Licence gives the purchaser permission to make and sell up to 20 finished physical items from the Frostberry Hollow pattern (Design 30) by The Toymaker’s Journal.

This listing is for the commercial licence only. The Frostberry Hollow pattern is sold separately and must be purchased before this licence can be used. The licence is valid only when retained with the purchase receipt or receipts for both the Frostberry Hollow pattern and its matching Commercial Licence.

What This Licence Allows

·         Up to 20 finished physical items may be made and sold from the licensed Frostberry Hollow pattern.

·         The 20-item allowance is a total production allowance. It does not renew annually.

·         Finished items may be sold through weekend markets, craft fairs, online marketplaces, your own website, social media pages and direct customer orders.

·         Items made solely for personal use or given as genuine gifts do not count towards the commercial allowance.

·         Finished items must be made by the licence holder or within the licence holder’s own small maker business.

How the 20-Item Allowance Is Counted

·         Every item made for commercial sale counts towards the allowance, whether or not it is ultimately sold.

·         Where a pattern creates a complete multi-piece set, one complete set sold together counts as one finished item.

·         Where pieces from a set are made or sold separately, each separate piece counts as one finished item.

·         Once 20 commercial items have been produced, no further items may be made for sale unless additional commercial rights are purchased.

·         Finished stock lawfully produced within the allowance may continue to be sold, unless the licence has been terminated for deliberate infringement or dishonest conduct.

Important Restrictions

·         This licence is non-exclusive and non-transferable. It may not be sold, shared, transferred, assigned or sublicensed to another person or business.

·         Factory production, mass production, outsourced manufacturing and commercial production by an unrelated third party are not permitted.

·         The pattern, instructions, illustrations and digital files may not be copied, shared, sold, uploaded, redistributed or supplied to another person.

·         The pattern may not be used to create or sell another pattern, template, plan, tutorial, kit, digital product or production file.

·         The pattern may not be converted and distributed as an SVG, DXF, CAD, CNC, laser-cutting or other digital cutting file.

·         Files may be prepared for use with your own equipment only, provided they remain private and are not sold, shared or distributed.

·         Minor decorative or practical changes may be made to finished items, but those items remain covered by this licence and count towards the production allowance.

Marketing and Attribution

You may use your own photographs and videos of the finished items you have made. Photographs, illustrations, listing graphics, written descriptions, logos and other branded material belonging to The Toymaker’s Journal may not be used without written permission.

Where practical, online listings should include:

“Handmade under licence from an original pattern by The Toymaker’s Journal.”

The licence holder must not claim ownership of the original design or imply that finished items were made, inspected, tested or approved by The Toymaker’s Journal.

Safety and Legal Responsibility

The licence holder is responsible for the materials, construction, quality, safety and legal compliance of every finished item made or sold. This includes any required testing, warnings, labels, registrations, permits, insurance and compliance with the laws and safety standards that apply where the item is sold. The Toymaker’s Journal does not manufacture, inspect, test or certify finished items made by the licence holder.

The licence holder is also responsible for all customer sales, returns, repairs, complaints and claims relating to their finished items.

Ownership and Acceptance

All rights in the Frostberry Hollow pattern, design, instructions, images and associated materials remain with The Toymaker’s Journal or the identified rights holder. This licence grants limited commercial permission only. It does not transfer copyright, design ownership, trademarks, character rights, story rights or any other intellectual property.

By purchasing or using this licence, the purchaser confirms that they have read, understood, and accepted the full terms set out in the supplied Commercial Licence PDF.

PLEASE NOTE: This purchase does not include the Frostberry Hollow pattern, any SVG cutting file, a physical product, custom pattern work or production services. The pattern must be purchased separately.

Commercial licences are non-exclusive. The Toymaker’s Journal reserves the right to limit, suspend or discontinue commercial licensing for any design at any time in order to protect the scarcity, reputation and market value of the finished work.

Digital Delivery

This is a digital product. After purchase, you will receive the four-page TMJ-LA20PCE Commercial Licence agreement as a PDF download. No physical item will be posted.
